Please read these Terms of Use carefully before accessing or using any part of the Eskalorraine platform available at eskalorraine.com. By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
Throughout these Terms, the following definitions apply:

2. Acceptance of Terms
By creating an Account, enrolling in a course, attending a Session, or otherwise using any feature of the Platform, you enter into a legally binding agreement with Eskalorraine governed by these Terms of Use and any additional policies incorporated herein by reference, including our Privacy Policy.
These Terms apply to all Users regardless of the type of access — free, trial, or paid. If you are using the Platform on behalf of an organization or legal entity, you represent that you have authority to bind that entity to these Terms, and references to "you" include that entity.
3. Eligibility
3.1 Age Requirements
You must be at least 16 years of age to create an Account and use the Platform independently. Users under the age of 18 must have verifiable consent from a parent or legal guardian. We reserve the right to request proof of age or parental consent at any time.
3.2 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate. Providing false or misleading information is grounds for immediate account suspension or termination.
3.3 Prohibited Users
You may not use the Platform if you have previously had an Account terminated by us for violations of these Terms, or if applicable law in your location prohibits you from receiving online services of this type.
4. Account Registration and Security
4.1 Account Creation
To access certain features of the Platform, you are required to register for an Account. You agree to choose a strong, unique password and to keep your login credentials confidential. You are solely responsible for all activity that occurs under your Account.
4.2 Unauthorized Access
If you suspect unauthorized access to your Account or any breach of security, you must notify us immediately at contact@eskalorraine.com. We will not be liable for any loss or damage resulting from your failure to safeguard your credentials.
4.3 Single Account Policy
Each individual may maintain only one active personal Account. Creating duplicate or multiple Accounts is not permitted and may result in the suspension of all associated Accounts.
4.4 Account Sharing
Your Account is personal and non-transferable. Sharing login credentials with third parties or allowing others to use your Account to access paid content is strictly prohibited and constitutes a material breach of these Terms.
5. Services Description
5.1 Platform Features
Eskalorraine provides an online educational environment focused on marketing analytics, offering a combination of group sessions, individual lessons, personalized learning paths, and live interaction with qualified Instructors. The Platform supports learners in choosing between collective and private learning formats.
5.2 Service Availability
We endeavor to maintain continuous availability of the Platform but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to scheduled maintenance, technical updates, or circumstances beyond our control. We will make reasonable efforts to notify Users in advance of planned downtime.
5.3 Service Modifications
We reserve the right to modify, suspend, or discontinue any feature or aspect of the Platform at any time. We will provide reasonable notice where practicable. Your continued use of the Platform following any modification constitutes acceptance of the updated service.
5.4 Third-Party Integrations
The Platform may integrate with or link to third-party tools, services, or platforms. We are not responsible for the content, functionality, or policies of any third-party service. Your use of such third-party services is governed solely by their respective terms and policies.
6. Payments, Subscriptions, and Refunds
6.1 Pricing
Access to certain courses, Sessions, or features may require payment. Current pricing is displayed on the Platform and is subject to change. We will notify registered Users of material pricing changes in advance.
6.2 Billing
All fees are charged in the currency specified at the time of purchase. You authorize us to charge the applicable payment method for any fees related to your chosen plan or purchase. You are responsible for all applicable taxes unless otherwise stated.
6.3 Subscriptions
Where subscription plans are offered, they renew automatically at the end of each billing cycle unless cancelled prior to the renewal date. You may cancel your subscription at any time through your Account settings. Cancellation takes effect at the end of the current billing period.
6.4 Refund Policy
Refund eligibility depends on the type of service purchased. Digital course content that has been accessed or downloaded is generally non-refundable once delivery has begun. For live Sessions, refund requests must be submitted at least 24 hours before the scheduled start time. We evaluate refund requests on a case-by-case basis. 6.5 Failed Payments
If a payment fails, we may suspend access to paid features until the outstanding balance is settled. We will attempt to notify you of any payment failure using the contact information associated with your Account.
7. Intellectual Property
7.1 Platform Ownership
All Content, trademarks, logos, software, design elements, and materials published on the Platform are the intellectual property of Eskalorraine or its licensors and are protected by applicable intellectual property law. Nothing in these Terms grants you any ownership right in any Content or Platform element.
7.2 Limited License to Users
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its Content solely for your personal, non-commercial educational purposes. This license does not include the right to:
— Reproduce, distribute, or publicly display any Content
without prior written permission
— Create derivative works based on Platform Content
— Use any data mining, scraping, or automated data
collection methods on the Platform
— Reverse engineer or attempt to extract source code from
any part of the Platform
7.3 User-Submitted Content
If you submit, upload, or share any content on the Platform — including comments, forum posts, assignments, or portfolio work — you retain ownership of that content but grant us a worldwide, royalty-free, perpetual license to use, display, and reproduce it for the purpose of operating and improving the Platform. You represent that you have all rights necessary to grant this license.
7.4 Feedback
Any feedback, suggestions, or ideas you provide regarding the Platform may be used by us freely and without compensation or obligation to you.
8. Acceptable Use Policy
8.1 Permitted Use
You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms, all applicable laws, and the rights and dignity of other Users and Instructors.
8.2 Prohibited Conduct
The following conduct is strictly prohibited on the Platform:
— Uploading, transmitting, or distributing content that is
unlawful, defamatory, harassing, abusive, fraudulent,
obscene, or otherwise objectionable
— Impersonating any person or entity or misrepresenting your
affiliation with any person or entity
— Attempting to gain unauthorized access to any part of the
Platform or other Users' Accounts
— Distributing malware, viruses, or any other malicious
code
— Using the Platform to send unsolicited commercial
communications
— Engaging in any activity that disrupts, interferes with,
or places unreasonable load on the Platform's
infrastructure
— Circumventing any access control or digital rights
management measures
— Recording, capturing, or redistributing live Session
content without explicit prior written consent from
Eskalorraine and the relevant Instructor
— Using the Platform for any competitive intelligence,
benchmarking, or commercial data collection purpose
8.3 Reporting Violations
If you become aware of any misuse of the Platform or content that violates these Terms, please report it to us at contact@eskalorraine.com. We will investigate all credible reports and take appropriate action.
9. Session Conduct and Participation
9.1 Expected Behavior
All participants in live Sessions — whether group or individual — are expected to maintain a respectful and professional environment. Disruptive, abusive, or inappropriate behavior during Sessions may result in removal from the Session and disciplinary action against your Account.
9.2 Recording of Sessions
Sessions may be recorded by Eskalorraine for quality assurance, review, and educational purposes. By participating in a Session, you consent to such recording. You may not record any Session independently without express written permission from Eskalorraine.
9.3 Scheduling and Cancellations
For individual Sessions, cancellations or rescheduling requests must be submitted at least 24 hours before the scheduled time. Late cancellations may result in forfeiture of the Session fee. We reserve the right to reschedule or cancel Sessions due to Instructor unavailability or technical issues, in which case affected Users will be offered an alternative time or a refund.
10. Privacy and Data
Your privacy is important to us. Our collection, use, and storage of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data practices described in the Privacy Policy. You can contact us regarding data matters at contact@eskalorraine.com.
11. Disclaimers and Limitation of Liability
11.1 No Educational Outcome Guarantee
We make no guarantee that use of the Platform will result in specific learning outcomes, professional qualifications, career advancement, or employment. Results depend on individual effort, prior knowledge, and other factors beyond our control.
11.2 Platform Provided "As Is"
The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be error-free, secure, or continuously available.
11.3 Limitation of Liability
To the fullest extent permitted by applicable law, Eskalorraine, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from:
— Your access to or use of, or inability to access or use,
the Platform
— Any conduct or content of third parties on the Platform
— Unauthorized access to your Account
— Interruption or cessation of any service
— Any errors, omissions, or inaccuracies in Content
11.4 Maximum Liability Cap
In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the total amount paid by you to Eskalorraine in the twelve months immediately preceding the event giving rise to the claim, or one hundred US dollars (USD $100), whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Eskalorraine and its affiliates, directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
— Your use of the Platform in violation of these Terms
— Any content you submit or transmit through the Platform
— Your violation of any applicable law or the rights of any
third party
— Any dispute between you and another User or Instructor
13. Termination and Suspension
13.1 Termination by You
You may terminate your Account at any time by contacting us at contact@eskalorraine.com or by using the account deletion option in your Account settings. Termination does not entitle you to refunds for prepaid services unless otherwise specified in our refund policy.
13.2 Termination by Us
We reserve the right to suspend or permanently terminate your Account and access to the Platform at our sole discretion, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to the Platform or other Users.
13.3 Effect of Termination
Upon termination, your right to access the Platform ceases immediately. Any licenses granted to you under these Terms are revoked. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitations of liability, and indemnification — shall remain in full force.
14. Modifications to These Terms
We reserve the right to update or modify these Terms at any time. When changes are made, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice through the Platform or via the email address associated with your Account at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Platform and may terminate your Account.
15. Governing Terms and Dispute Resolution
15.1 Good Faith Resolution
In the event of any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform, you agree to first attempt to resolve the matter informally by contacting us at contact@eskalorraine.com. We will make reasonable efforts to resolve the dispute within 30 days of receiving written notice.
15.2 Formal Proceedings
If informal resolution is unsuccessful, either party may pursue resolution through binding arbitration or other legally available dispute resolution mechanism appropriate to the circumstances. Each party agrees to resolve disputes individually and not as part of any class, collective, or representative proceeding.
15.3 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.
16. Miscellaneous
16.1 Entire Agreement
These Terms of Use, together with our Privacy Policy and any additional terms applicable to specific services, constitute the entire agreement between you and Eskalorraine with respect to the Platform and supersede all prior agreements, representations, and understandings.
16.2 No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Eskalorraine to be effective.
16.3 Assignment
You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent. We may freely assign these Terms or any of our rights hereunder without restriction.
16.4 Force Majeure
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of war, cyberattacks, governmental actions, power outages, or internet infrastructure failures.
16.5 Language
These Terms are written in English. In the event of any inconsistency between an English version and a translated version of these Terms, the English version shall prevail.
